In the event that, after we accept your order, we discover that the goods ordered are unavailable or that there was a pricing error on our website in respect of the goods ordered, we reserve the right not to supply the goods ordered and to offer you a refund
O’Leary Motor Homes will not pass on any personal or credit or debit card details to any third party. Any credit or debit card information that we collect will only be used for processing your order only. Card payments are processed via Sagepay a secure Payment Service Provider.
You agree that all details you have provided to O’Leary Motor Homes for the purpose of ordering and purchasing goods or services are correct, and that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.
If there are any changes to the details supplied by you it is your responsibility to inform O’Leary Motor Homes as soon as possible.
All purchases are non-exchangeable, non-refundable and non-transferable unless agreed.
Once O’Leary Motor Homes receive notification from you that you wish to withdraw from the contract (in accordance with these terms), any sum debited to O’Leary Motor Homes from your card in relation to your order will be re-credited to that account as soon as possible and in any event within 30 days of your order provided that the goods you wish to return are received by O’Leary Motor Homes in the condition that they were in when delivered to you. You will be liable for any charges incurred in returning the goods to O’Leary Motor Homes unless the goods are faulty.
Should you wish to return a product to us, you must contact us first. It is your duty to return goods to us at your cost, unless faulty. When goods are received they will be inspected. If goods are faulty, we will refund all charges, including your cost of sending goods back to us up to the value we charges for delivery of your order. Should the item just be an unwanted product, we do not refund your carriage charges incurred sending the goods back, but we will refund the full price of the order providing they are returned within 7 days of receipt of goods. As soon as we have accepted the goods back we will inform you of this and that a credit has been placed. On some occasions where products are badly damaged or not returned due to the reason specified, we reserve the right to refuse to accept the return. On items that are a special order and have been dispatched direct from our supplier, there may be a restocking charge unless goods are faulty.
O’Leary Motor Homes does not accept liability (except as set out below) for any errors and omissions and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services.
If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. In the event that you order an item and the price published on the site is incorrect for any reason, we will contact you to let you know the correct price and ask you whether you still wish us to fulfil your order at this price. We shall be under no obligation to fulfil an order for a product, which was advertised at an incorrect price. We shall give you the option of confirming the order at the correct price or if you so choose, to cancel the order altogether. If you cancel and have already paid for the goods in the circumstances described in this clause, we shall refund the full amount in accordance with these Terms.
There may be occasions when an item we have listed, is not currently in stock and our suppliers are out of stock. When this happens we will email you of this, giving you an option to cancel the order. Automatically, we will keep the item on backorder and dispatch it as soon as it arrives. However, after 28 days, if the item has still not been made available by our supplier, we reserve the right to cancel the product that is out of stock from your order, and provide you with a refund.
O’Leary Motor Homes will do its best to correct errors and omissions as quickly as practicable after being notified of them.
In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, O’Leary Motor Homes shall, at its own option, make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question provided that you notify O’Leary Motor Homes of the problem in writing at the address stated or by e-mail within 3 working days of delivery of the goods. This does not affect your statutory rights.
You and O’Leary Motor Homes will only be liable under these Terms for losses that are a reasonably foreseeable consequence of the relevant breach of contract.
All products are covered by a manufacturer's warranty. If your product develops a fault while under warranty, please contact O’Leary Motor Homes and we will advise you where to send it for repair.
Credit and Debit cards may be debited on the day of payment by the agreed payment service, although we reserve the right to process your payment at a later time. All final prices include sales taxes (where applicable) unless otherwise stated.
All refunds must legally provided within 30 days, but sooner if possible. Our systems allow us to provide immediate refunds (upon receipt of goods where required), but these do depend on the merchant used to make payment. Credit / Debit card payments are processed via Secure Trading every morning and it is during this processing that funds are returned to your card provider. If payment was made the same day as the refund is processed, we can void the transaction. This means that no payment is taken, so there is no refund to process.
All refunds are processed through the method that you chose to make the original payment. This is a stipulation of our payment processors, and in many cases a legal requirement, to prevent financial fraud.
Every purchase you make shall be deemed performed in the United Kingdom. UK law shall govern every aspect of contractual agreement concerning purchases made from the Site.
O’Leary Motor Homes aims to arrange shipment of all items within the stated period of receiving your order. Your order may be delayed if the item is not in stock with us or our suppliers. Some items may be unavailable. O’Leary Motor Homes are not able to guarantee supply dates our suppliers may get an item in stock. Please also note that we are required to pass a contact number onto our delivery couriers in order to contact you should there be a problem locating your delivery address.
Should no-one be able to take delivery of your item, our courier may leave the package with a neighbour if you instruct us this is suitable.
O’Leary Motor Homes allows customers to have items delivered to different addresses to the billing address, and this can be requested though our checkout process.
Should your package be returned to us, we can arrange to send the items back out to you. We also reserve the right to apply an extra delivery charge. The extra charge is to cover charges we incur from our couriers. Should you not agree to this, we will issue a refund for your items only (not including the delivery charge).
O’Leary Motor Homes is not responsible for any additional costs incurred by any customer due to reasons beyond our control, ie late delivery, items being out of stock or product line cancellation.
If your delivery address is outside of the EEC, you may be subject to import duties and taxes, which are levied once a shipment reaches your country. Any such additional charges for customs clearance must be borne by you. You should note that customs policies vary widely from country to country; O’Leary Motor Homes advises each customer to contact their local customs office for further information.
Please note that when shipping products internationally, you should be aware that cross-border shipments are subject to opening and inspection by customs authorities.
For seasonal deliveries, we recommend that you order early. We will try to dispatch all orders within 24 hours. But this may not always be possible. We will contact you regarding delivery times of any products that are not immediately available.
We shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.
We shall have no liability (including liability for negligence) for the acts or omissions of telecommunications service providers or for failures of, or faults in their networks and equipment.
No waiver by us of any breach of these Terms shall be considered as a waiver of any subsequent breach of the same or any other provision.
